PUBLIC EMERGENCY DECLARATION FOR THE TOWN OF HAMDEN

PUBLIC EMERGENCY DECLARATION
FOR THE TOWN OF HAMDEN

WHEREAS, on March 10, 2020, the Governor of the State of Connecticut, the Honorable Ned Lamont, declared a public health emergency and a civil preparedness emergency for the State of Connecticut, pursuant to Connecticut General Statutes Sections 19a-131 and 28-9, in response to the global pandemic of COVID-19 disease associated with a novel coronavirus that is currently affecting multiple countries and states; and,

WHEREAS, on March 13, 2020, the President of the United States declared a national emergency pursuant to Section 501 (b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, 42 U.S.C. 5121-5207 (“the Stafford Act”); and

WHEREAS, Section 5-5 A. of the Charter of the Town of Hamden states: A public emergency pertaining to the Town may be declared by the Mayor; and,

WHEREAS, Section 5-5 B. of the Charter of the Town of Hamden states: The Mayor shall exercise within the limits of the Town, all the emergency powers given to the chief executive officer of a municipality under the General Statutes with regard to the allocation of personnel. Upon the declaration of a public emergency, the Mayor may mobilize, organize and direct the forces of the Town and call upon and cooperate with the federal government or the State or its political subdivisions; and,

WEREAS, the effects the spread of COVID-19 have resulted in the spread of infections in both Connecticut, Greater New Haven and neighboring states; and

WHEREAS, due to the significant adverse impact on public health of COVID-19, the Mayor must take action for the purpose of mitigating the adverse effects of this emergency situation upon the residents of Hamden.

NOW, THEREFORE I HEREBY DECLARE that pursuant to Connecticut General Statutes Section 28-8a(a) and 28-22a and Section 5-5 A. of the Charter, a public emergency is hereby declared for the Town of Hamden.

I FURTHER DECLARE, that the public emergency shall exist until declared to be terminated.

I FURTHER DECLARE that during the existence of said emergency the Chief Executive of the Town of Hamden, Connecticut, its Mayor, Curt Balzano Leng shall assume the powers, functions a duties prescribed by law, including but not limited to Connecticut General Statutes Sections 28-8a(a) and 28-22a, and Section 5-5 of the Hamden Charter and may take such actions as necessary to protect the public health and mitigate this emergency.
